These Terms & Conditions (the "Terms") are a legal agreement between you ("you" or "Customer") and Fubit, a sole proprietorship ("Fubit", "we", "us", "our"), operator of the website fubit.co and of the management software for restaurants, bars and cafés (the "Service"). By accessing the website or using the Service, you agree to be bound by these Terms. If you do not agree with them, you must not use the Service.
Fubit provides a point-of-sale (POS) and management system for restaurants, bars and cafés, including orders, table management, inventory and stock control, accounting, QR digital menu, kitchen display system, supplier management and real-time operational metrics.
You must create an account to use the Service. You represent that you are of legal age and have the legal capacity to accept these Terms. You are responsible for keeping your access credentials confidential and for all activity that occurs under your account. You must provide true, accurate and current information and keep it up to date for the duration of your account.
The Service is offered through paid subscriptions with 1-day, 7-day and 30-day plans. Prices are published on fubit.co and may change from time to time. By subscribing, you authorize the applicable charge and, unless you cancel beforehand, recurring charges for automatic renewals at the end of each billing period. Cancellation will take effect at the end of the current billing period and you will not be charged again.
All payments are processed and collected by Paddle.com as Merchant of Record (see Section 5). Applicable taxes are calculated and charged according to your billing jurisdiction.
Merchant of Record: Paddle.com. Fubit uses Paddle.com ("Paddle") as its Merchant of Record for all subscription payments. All payments are processed and collected by Paddle on behalf of Fubit. By making a purchase, you agree to Paddle's terms and conditions and acknowledge that your payment data will be handled by Paddle. Refund requests are processed through Paddle in accordance with our Refund Policy.
We offer a 30-day money-back guarantee from the date of purchase. If you are not satisfied with the Service, you may request a full refund within 30 days. See our Refund Policy for details and instructions.
The Service, including its software, design, trademarks, logos and content, is owned by Fubit or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service solely in accordance with these Terms. You retain ownership of the data you upload to the Service.
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be error-free or uninterrupted, or that the results obtained will be accurate or reliable.
To the maximum extent permitted by law, Fubit shall not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising from the use of or inability to use the Service. Fubit's total liability for any claim relating to the Service shall not exceed the amount you paid for the Service in the 30 days preceding the claim.
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access to the Service if you breach these Terms, without prejudice to our other rights. Upon termination, provisions that by their nature should survive, such as those relating to intellectual property, limitation of liability and governing law, will remain in effect.
We may update these Terms from time to time. Changes will be posted on this page with a revised update date. If you continue to use the Service after the changes take effect, you will be deemed to have accepted them.
These Terms are governed by the laws of the Republic of Colombia, without prejudice to any mandatory rules of the Customer's place of residence. Any dispute relating to these Terms shall be submitted to the competent courts of Colombia.
